By using BrandGene, you agree to these Terms of Service. If you don"t agree, please don"t use our service.

We may update these Terms from time to time. Continued use of the service means you accept any changes. We"ll notify you of significant updates via email or on our website.

2. Service Description

BrandGene is an AI image generation platform powered by Google"s Gemini API. We provide:

• AI image generation from text prompts
• Credit-based usage system
• Educational resources and documentation

Note: This is an independent platform, not affiliated with Google."Gemini" is a trademark of Google LLC.

3. User Accounts

You must create an account using Google OAuth to use our service. You agree to:

• Provide accurate information
• Keep your account secure
• Be at least 13 years old
• Not share your account or create multiple accounts to abuse free credits
• Not use automated tools or circumvent usage limits

You"re responsible for all activity under your account. We may suspend or terminate accounts that violate these terms.

Account Deletion: You may permanently delete your account and all associated data at any time from your Profile page. Deletion is immediate and irreversible. Any remaining credits or active subscriptions will be forfeited without refund. See our Privacy Policy for details on data handling.

4. Credits and Payments

Our platform uses a credit system. New users receive free credits. Additional credits can be purchased at various price points.

• Payment Processing: Handled securely by Creem.io
• Credit Expiration: Purchased credits may expire monthly (see purchase terms)

• Used Credits: Cannot be refunded once used

For billing issues, contact support@brandgene.io within 30 days.

Abandoned Cart Recovery: If you initiate a checkout but do not complete the purchase within 24 hours, we may send you reminder emails to help you complete your transaction. By initiating checkout and providing your email address, you consent to receive these recovery emails. You can opt-out of these communications at any time using the unsubscribe link in the email.

5. Acceptable Use

You may not use our service to create or generate:

• Illegal content or child sexual abuse material (CSAM)
• Content promoting violence, terrorism, or hate speech
• Sexually explicit or pornographic content
• Content that infringes intellectual property rights
• Spam, malware, or fraudulent content

You may not:

• Reverse engineer or disrupt our service
• Use automated scraping or data collection
• Impersonate others or provide false information

Violations may result in immediate account termination without refund.

6. Intellectual Property

Generated Images: You own the images you create. However, similar images may be generated for other users from similar prompts due to AI"s nature.

Platform Content: Our website, tutorials, and documentation are protected by copyright.

AI Disclaimer: AI-generated images may contain inaccuracies, biases, or unexpected elements. You"re responsible for reviewing content before use. We"re not liable for issues arising from AI-generated images.

7. Service Availability & Liability

Service provided "AS IS": We strive for reliable service but don"t guarantee 100% uptime. Service may be unavailable due to maintenance, technical issues, or third-party disruptions.

Limitation of Liability: To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the past 12 months. We"re not liable for indirect damages or third-party services (Google, Creem, etc.).

Credits from failed generations are typically refunded automatically.
